Terms of Service

PulsedMC ("we," "us," or "our") provides hosting and the tools around it (together, the "Service"). This includes:

• Minecraft server hosting, including free servers
• Hosting for other games
• Website hosting and Discord bot hosting
• Windows virtual private servers ("VPS")
• Our game panel, website, Discord server and bots, support system, PulsedAI, and any other service that links to these Terms

You are responsible for everything that happens on your servers and VPSes. That includes the conduct of your players and users, the software, plugins and mods you install, and the content you or your community create.

You must be at least 13 years old to use the Service. If you are under 18, a parent or legal guardian must have read and agreed to these Terms on your behalf.

By using the Service, you confirm that:

• You have the legal capacity to enter into a binding contract
• You are not located in a country subject to U.S. government embargo or sanctions
• You are not on any government list of prohibited or restricted parties
• Your use of the Service does not break any law that applies to you

You are responsible for keeping your account secure, including your website account, your panel login, any VPS administrator password, and any Discord account you link. Tell us straight away if you think someone else has access to your account.

You are responsible for everything done through your account.

• Use a strong, unique password and turn on two-factor authentication if you can
• Do not share your passwords, VPS credentials or account access with anyone
• One person may hold only one free server. Creating extra accounts to get more free servers, more promotional credits, referral rewards, giveaway entries or discounts is not allowed
• You may not sell, transfer or give away your account without our permission

Card payments are processed by Stripe, Inc. If we offer other payment methods at checkout, those providers process those payments. We never see or store your full card number. Credits can be bought once, or through an optional monthly credit refill. If you choose the monthly refill, you authorise us to charge your payment method every month until you cancel it.

• Prices are shown in USD and do not include any taxes that may apply where you live
• Each server, VPS and add-on has a monthly credit price. It is charged roughly once a month from the date you created it
• Add-ons include extra backup slots, extra storage and Online 24/7. They are charged every month on top of the plan until you remove them
• When you upgrade a plan or add an add-on part way through a month, we charge the part of the month that is left. If the renewal date has already passed, we charge a full month
• Downgrades and removed add-ons do not give credits back. They lower what you pay from the next renewal
• If your balance cannot cover a renewal, that server or VPS is suspended. See Termination for what happens next
• You can cancel a monthly credit refill at any time from your account page. This stops future top-ups but does not delete anything you already have
• We may change prices with at least 14 days' notice
• Free servers come with limits. We may change what the free tier includes at any time

Promotions. Discount codes, referral rewards, giveaway prizes and other promotional credits have no cash value, cannot be transferred, and can be withdrawn or changed at any time. Each code can be used once per customer unless it says otherwise. If we find that a promotion was obtained by abuse, such as with extra accounts, we may remove the credits or anything bought with them.

Server Spotlight. Server Spotlight promotes your server on the PulsedMC website and in the in-game server selector. Activating it takes 2,000 credits straight away and runs for 30 days. At the end of each 30 days we try to take 2,000 credits again. If your balance is too low, the promotion ends. Credits used for Server Spotlight are not refundable.

Credits are added to your account as soon as your payment is confirmed. By buying credits, you agree that they will not be refunded for any reason. That includes unused credits, account closure, suspension or termination, and change of mind. Credits have no cash value and cannot be exchanged for money.

Opening a chargeback or payment dispute for a credit purchase breaks these Terms. If you do, we may:

• Suspend or permanently close your account without notice
• Remove the credits from the disputed payment, and anything bought with them
• Respond to the dispute with our records and pursue recovery through the payment provider or other legal means

If you think you were charged by mistake, contact us first. We will review it, and at our own discretion may make an exception for:

• Duplicate charges caused by a technical error on our side
• Outages longer than 72 hours in a row caused only by a failure of PulsedMC infrastructure

You must not use the Service, including any server, VPS, website or bot you host with us, for anything unlawful or harmful. In particular, you must not:

• Illegal content: host, share or link to anything illegal where you or we are, including child sexual abuse material (CSAM). We report CSAM to the authorities
• Attacks: run DDoS or flooding attacks, stress testers or "booters", port scans, vulnerability scans or brute-force login attempts against any system you do not own or have written permission to test
• Malware: create, host or spread viruses, ransomware, spyware, stealers, botnets or command-and-control servers
• Phishing and fraud: host phishing pages, scams, fake shops, or anything that collects other people's passwords or payment details by deception
• Spam: send unsolicited bulk email or messages, or run an open mail relay. Outgoing email on port 25 is blocked on every VPS
• Anonymity networks and proxies: run Tor relays, Tor exit nodes or hidden services, open proxies, or VPN or proxy services offered to other people, or use the Service to reach dark web marketplaces or other illegal services
• Cryptocurrency mining: mine cryptocurrency on any server or VPS
• Stolen data: store or trade leaked databases, stolen accounts or credentials, or people's private information, and do not dox or harass anyone
• Piracy: host or share copyrighted material you do not have the right to share, including cracked software and paid plugins or mods
• Our systems: try to get around our network protections, limits, sleep system or billing, try to reach other customers' servers or VPSes, or try to exploit weaknesses in our infrastructure
• Excessive use: use so much CPU, disk or network that it harms other customers on the same machine
• Reselling: resell or sublicense the Service without our written permission
• Impersonation: pretend to be PulsedMC, our staff, or any other person or organisation
• Minecraft rules: follow Mojang's End User Licence Agreement and Usage Guidelines
• Windows: follow Microsoft's licence terms for the copy of Windows on your VPS

If we see a breach, or a real risk to our network, our IP addresses or other customers, we may stop, suspend or delete the server, VPS or account straight away, without notice and without a refund. We may report illegal activity to the authorities and share information with them as described in our Privacy Policy.

To protect our network and other customers, every VPS runs behind automatic protections. These include:

• Outgoing email on port 25 is blocked
• Domain lookups (DNS) go through our own filter, which blocks known malware, phishing and scam sites. Lookups to other DNS servers are blocked
• Traffic between different customers' VPSes, and from a VPS to our own internal systems, is blocked
• New connections are rate limited, and repeated login attempts against other systems are limited

When a protection is triggered, our systems record which VPS triggered it, which protection, and how many times. Our staff are alerted automatically. We do not record the contents of your traffic.

We also record resource usage for every VPS (CPU, memory, network and disk activity) to show you usage graphs and to spot abuse.

These protections can block things you meant to do. If one gets in your way for a legitimate reason, open a ticket and we will look at it. Trying to get around them breaks these Terms.

You keep ownership of everything you upload or create on the Service ("Your Content"). You give PulsedMC a limited, non-exclusive licence to store, copy, back up and transmit Your Content only as needed to run the Service.

You confirm that Your Content does not:

• Infringe anyone's copyright, trademark or other rights
• Include illegal material, including child sexual abuse material (CSAM)
• Break anyone's privacy or data protection rights

Our access. As the host, we can technically access the files on your servers and VPSes. Staff only do so to provide support you ask for, to fix problems, to investigate abuse or a breach of these Terms, or when the law requires it. On a VPS we use a guest agent built into the machine for things like password resets.

Backups. Backups are a convenience, not a guarantee. Server and VPS backups are kept on the same machine as the server or VPS, so a hardware failure can lose both. Backups are deleted when the server or VPS they belong to is deleted. Keep your own copies of anything important.

Public content. Some things you create are public. This includes your server's name, address, status, player count and description in our server lists and in-game selector, reviews you post, forum posts, and anything you put on a website you host with us.

Copyright complaints. If you believe something on our Service infringes your copyright, email [email protected] with the location of the material, the work it infringes, and your contact details. We will remove material that we find infringing, and may close the accounts of repeat infringers.

The Service, including our software, designs, trademarks and content, is owned by or licensed to PulsedMC and is protected by intellectual property laws. You may not copy, modify, distribute or reverse-engineer any part of it without our written permission.

Nothing in these Terms gives you any intellectual property rights beyond the limited right to use the Service.

We work to keep the Service reliable, but we do not promise it will always be available or free of errors.

• Sleep: servers go to sleep after 10 minutes with no players online and wake when someone joins, unless you have the Online 24/7 add-on
• Maintenance: we may carry out planned maintenance with reasonable notice, and emergency maintenance without notice
• Moving servers: we may move a server or VPS to another machine or location to keep the Service running well. Its IP address or port may change when we do
• Changes: we may change or remove features with reasonable notice

We will try to warn you about large planned outages in our Discord server or by email.

By you. You can delete a server or VPS at any time from your account. You can also delete your whole account, which deletes every server, VPS and backup on it. Deletion happens straight away and cannot be undone.

Unpaid servers. If your balance cannot cover a server's renewal, the server is suspended and we email you. It comes back by itself when your balance can cover it. If it is still suspended after 7 days, the server and all its data are permanently deleted.

Unpaid VPSes. If your balance cannot cover a VPS renewal, the VPS is shut down and suspended, and we email you. Its data is kept while it is suspended, and it starts again by itself once your balance can cover the renewal. If it is still suspended after 14 days, we may permanently delete it and its backups.

Unused free servers. If a free server has not been used for 15 days, we email you a warning. If it is still unused 48 hours later, it is permanently deleted.

By us. We may suspend or close your account, or any server or VPS, at any time and without notice if we believe you have broken these Terms, or that your use puts the Service, our network or other customers at risk. In serious cases, such as illegal activity or attacks, there is no refund.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

As far as the law allows, PulsedMC and its owners, staff and affiliates are not liable for:

• Indirect, incidental, special, consequential or punitive damages
• Loss of profits, data, goodwill or business opportunities
• Damage caused by being unable to access or use the Service
• Damage caused by unauthorised access to your data, accounts or servers
• Anything that happens because of software, plugins, mods or content you or your users install

Our total liability to you for any claim about these Terms or the Service is limited to the amount you paid us in the 30 days before the event that caused the claim.

Some places do not allow some of these limits, so some of them may not apply to you.

You agree to defend and compensate PulsedMC and its owners, staff and affiliates for any claims, damages, losses, costs and expenses (including reasonable legal fees) that come from:

• Your use of the Service in breach of these Terms
• Your Content, or anything hosted on your servers, VPSes, websites or bots
• The actions of your players, users or anyone you give access to
• Your breach of anyone else's rights, including intellectual property rights
• Your breach of any law

These Terms are governed by the laws of the State of Ohio and the United States, without regard to conflict of law rules.

Before starting any legal proceeding, you agree to contact us and try to resolve the dispute informally for at least 30 days.

Any dispute that cannot be resolved informally will be settled by binding individual arbitration. You give up any right to take part in a class action or class-wide arbitration.

Report abuse coming from our network to [email protected]. Include the IP address and port, the time, and what happened.

We cooperate with valid legal requests. We may share account details, records and Your Content with law enforcement or other authorities when the law requires it, or when we believe it is necessary to prevent harm to a person or to protect the Service.

We may update these Terms. When we make important changes, we will post a notice in our Discord server or email the address on your account at least 7 days before they take effect.

If you keep using the Service after that date, you accept the new Terms. If you do not agree, stop using the Service and delete your servers and VPSes before then.
